If you have a court date - bring your rent with you... have a viable excuse as to why you haven't paid the rent and then tell the judge you have the rent in full - it all depends on the judge. Also, remember that no matter what state you're in - if they serve you with a notice of non-payment if they accept ANY money (even $50-$100) from you they must start the notice process over. I.E. in Florida we first post a 3 day notice then our attorney will post a 7 day notice then take it to a judge. If someone owes $4k and pays us $100 and we accept it we have to start the process all over from the 3-day notice, no matter where we are in the situation.
It usually depends on the landlord. Past experiences lead me to know that if the situation gets to the point of Legal Action, you may as well save your money because you're being booted either way. sorry :-(
