Can I sue the state of New Mexico over a ticket on my record i did not get being that i was not in the state or able to drive at the time
This is actually a question for my brother. He tried to get a license and they said him he couldn't do to a ticket on his record from New Mexico. At the time they said he got this ticket he could not drive and lived at home with my parents plus being under-aged and had never been to New Mexico. When he called the court house to ask about the ticket they told him that he would have to pay over $500 to pay off fees and then call the DMV to have his license reinstated. He told her he had never had a license and was not the one who got the ticket so why does he have to have his license reinstate. She told him that they made one up for him to put it in the system to keep him from getting a license in the future.
We are wondering do any lawyers who might read this think we have a case to sue the state and get this off his record.
