Pain and suffering in car accident
ok long story short I have a 95 Toyota corolla. shortly after I came back from driving it to Kentucky my airbags went off for no reason and broke my brand new phone bruised my rib and pinky. I said no to a doctor because I never have time between work and school. Toyota first said they couldn't do anything but then said they would look at it. they looked at it in June said someone would call around 4th of July weekend. ever since I've been driving around with no airbags. shockingly Toyota called the 6th of September saying they found no damage that would have caused this and took full responsibility. they said they can buy it back for what it's worth (2000) or get it fixed for free and give me a rental until is fixed. I haven't took the car in or faxed over the release form for the repairs. my question is do I go for pain and suffering settlement? I feel like they should at least fix my phone or give me some money for the days I had to miss work and almost getting fired. do you think I should go for pain and suffering and if so how do I go about that. the Toyota people are calling me back tomorrow. and if I should I'm not sure what to say.
