In south carolina is it legal to change a criminal charge to a differant charge for the same incident

i was charged w trafficing and over a month later the same evidence was used to charge me with possession of contraband in a state or county municipial facility/ per s.c.d.c. law. tha same jurisdiction that found the evidence is tha same one that have me charged

There is no law against using evidence for more than one conviction. Thats why the keep it in an evidence room or locker - to be used as needed. Traffiking and possession are comepletely different charges so, yeah, they can charge you with both. Theres probably more charges they could use the same evidence for if they wanted, but they usually go for the one they are sure they can get a conviction on. Personally i hope they get you off the streets for a very very long time.

If you were violating multiple laws, then they can charge you multiple times, all on the basis of the same evidence. (this is true anywhere)
