Workman comp issue feel left in the dark can my lawyer file a motion to re instate my benefits.

Problem is 2 separate situ. Initial injury, went back to same job and re injured my neck. Now both ins companies are fighting who is responsible. Its ben six mos without pay. Comp doc is in my side.

I would assume the company that you were employed at the time of the initial injury. If the company didn't ask for a clearance from your physician, they would most likely be responsible. If you disobeyed company safety rules, there could be disciplinary actions taken. To terminate you for a non-safety violation is a discriminatory action by the company where you injured and can be remedied by the E.E.O.C in your local area by calling 800-669 -4000 this number works anywhere in the U.S.

Did you go back to work without doctor's clearance? Then you waive WC for the second injury. The first, as long as it's not from negligence on your part, your employer should still be accountable for.

Against his will he cleared me to work without restrictions. So yes on paper I was cleared. I don't understand why my lawyer can't re instate my benefits.

Call the Compensation Board, and demand a hearing
