Two: Of course you can sue. People can sue for anything these days. Will you win? Not on your life. The forms you signed before having the device installed protects the medical personnel and facility form frivolous law suits such as the one you want to make.
You are saying you didn't sign anything I think you have forgotten that you sign any paper so I would go down to the doctors office and check your file you are allowed to look at it after you do that you will know what to do next good luck
