Can I ask for an autopsy be performed on my brother even if his wife doesn't want to? What about his(our) parents asking for one?

My brother is on his death bed, and while his wife seems to have answer for everything, how he got to this point over the last month seems suspicious. Hospice has taken over and to my understanding, goes over his medical records before determining whether he can be saved or not. One of our bigger issues, is we can't get any information from hospice without her consent and she is a power-hungry b**** and likes to have control. We don't know how or why hospice came to their decision and have to take his wife's word which is worth nothing.

We would like to have an autopsy done just to see if his dying/death is what she says. The family would be able to get some closure without having to wonder if there was more to what happened than what we know.

You need a court order for a post-mortem. It would be difficult if it is just you but if the whole family feels the same way, you can convince the court.

His wife has the first say so I don't think you can. You're parents don't have power over him anymore because he is married and is over 18

If he is married and you dont have her consent, then no. Unless you find a reason for the authorities to get involed then probably yes...

I was thinking maybe you could go to the police station and explain your situation and see if they can help you Iam so sorry that your family is going thur all this but be strong you and your family will be in my prayers

You can get hair samples, if you can get to him and have it analyzed for toxins on your dime and if there is anything in his system, take the results to the authorities. If you do it on the DL she'll never know and you get an answer wether to try and take it further or not. Good luck
P.S. try to get the root of the hair

Unless he has someone other than his wife listed on health care power of attorney, you might be SOL. Ask who is lusted on HIPAA forms to share medical info.

If you suspect foul play .. then report it to the police AND the doctor .. You don't have to wait until he dies. He can be tested for all sorts of thing NOW .. while he's alive. If he is well enough, you can even tell him .. and get him to sign a Medical Power of Attorney...which will give you rights to oversee his health care.
