Do I have to get a lawyer to get an uncontested divorce or can I just go to the Court House?

Just recently left my husband about 3weeks ago. I only have a part time job but, we both want this. We haven't even been married a year yet.

If it is uncontested & you both are in total agreement you can share the cost of one inexpensive atty. It will actually depend upon your state. Call the court house & ask. They should be able to tell you.

well, as far as I know, have to be separated for a year before you can apply for a divorce. as for getting the marriage annulled, probably need a lawyer.

It depends on your state. Some states, like Indiana, you can just download the forms off the internet, fill them out and file at the courthouse. $100 to file. 60 days and you are done, no having to be separated any length of time. Would need to both agree on the terms of property/debt division. But, other states do have a waiting period of time where you have to be "separated" before you can file for divorce. You can search online for the rules for filing for divorce by state, or goto the library to read a book on it. Every state has different rules.

If you have mutual property or debt or children I would get a lawyer.
