Regarding common law marriage, divorce and remarriage...

I was recently presented with this scenario: man & woman allegedly common law married years later go separate ways without obtaining legal divorce. Then they remarry some time later, license for new marriage is approved. Is the 2nd marriage legally valid??

I do t think you file for divorce under common law marriage, so second marriage should be legal , I think common law helps determine who is entitled to what should you go your separate ways.

hmmmmmmmm............reckin it depends on what state. some states recognize common law marriage, some don't.

This is one state, Kansas, that does recognize common law.

Both could probably claim abandonment of the first marriage, and obtain a divorce quickly, and cheaply. But I say no to the legality of the second marrage!

Well, I don't know much about common law marriage, but married people renew their vows all the time.

Why YES - - Only a few states recognize common marriage and even so it isn't Exactly legal and even so the Legal one over rides the other
