Is this legal?

I work at wal mart and am scheduled on thanksgiving to work 5pm-2am. now that part isn't bad, but after that I get 4 hours off, then have to work 6am-3pm. is it legal for them to schedule me these hours so close together or will I just have to endure it? because that's a long time to work.

Wal-Mat is known for it's cruelty among it's workers. This is the first year many stores are opening on Thanksgiving, so they have decided to make everyone work. I am surprised they gave you 4 hours off, but that's probably how they are getting away with this is giving that 4 hour break and no overtime for working on Thanksgiving. I don't know if it's legal-but it's WRONG, but they don't care.

Nah... Walmart sucks!! Definitely ok to be down on them. But unfortunately it's not illegal in anyway, at least as far as I can tell. :(

A bunch of jerks they are. In some places WallmMart is the only place that has openings and there's someone always in line to take your job. Then there's people like Cookierama's answer who say "just quit " if you don't like it. Boy, am I ever in a bad zzz mood today. I better get off this site before I say something really mean.

And you know what? I can't tell you how many commercials I have seen lately from Wal Mart and their "great place to work". Those cost millions of dollars each time to air. They should use that money to help their emoyees-maybe pay them better and not make them work 11 hours a day on Thanksgiving...geez. It would be different if they had asked for volunteers. That seems okay with me.

Oh, I've seen those commercials before. I don't know how the people who make them sleep at night. Of all the retail jobs I've had, I avoided Wal Mart like the plague. I'd rather work at McDonald's.

Let your supervisor know, or if you have to, go to your store manager. Depends on what state you are in, but in most cases it's not illegal. Typically they don't usually schedule back to back like that, so it was probably a mistake.

Alright. I live in Texas if that helps at all. I have been told that they have to allow 8 hours between full shifts unless they ask your permission to work them back to back. I may be wrongfully informed though.

On a Federal level there are not any laws or regulations regarding minimum number of hours between shifts, and looks like the Sate of Texas doesn't have any either... http://www.twc.state.tx.us/news/efte/work_schedules.html .

I don't think this is legal, it should be 8 hours in between your work schedule....I don't know how far you live from work & that's sure not enough rest time for anyone to drive or work and be well rested....I think you can also find out through the labor board online if this is legal..??..Do you get to have some time off after that..??..I sure hope so..!! Good luck..!

I get no time off after that. I work the next 4 days. All 8 hour shifts.

I'm pretty sure you have to have an 8 hour turn around period between shifts.

That is 11 hours in 1 day - Questionable Not Being that they Don't have 11 or 12 as Dedicated Work Shifts

Of course it's legal. Now they can't legally force you to be a walmart employer. If you feel that ill used you have every legal right to resign your job.

Yes they must ask about it. I bet we see this on the national news. If it is true and if it's on the national news, maybe it may be illegal but Seohira is one of or most respected members, and she researches everything, and she can't find any law against it. That would be 11 hours in one day on a holiday this person will have to work under those conditions of a pre-Christmas sale. It just breaks my heart.

It's definitely legal, but wrong. Whenever I was in situations like this in one of my retail jobs, I did everything in my power to find ways to work as little as possible and steal whatever wasn't nailed down. Do the least possible to keep your job. I'm so sorry for your situation.

@Studmuffin: forrespect.org is the website for the organization ourwalmart.org which is comprised of current and former Walmart employees fighting for better wages, benefits and respect and has backing from the UFCW (United Food and Commercial Workers) union. Please sign their declaration. Unions are responsible for the 40 hour workweek, child labor laws, health and safety requirements for workers and are worth every penny in union dues. Forrrespect also has a Facebook page that will keep you apprised of the protests and walkouts planned throughout the holiday season.

Hi, Sin & Reese! We kept Walmart out of California for years, much the same way France kept McDonalds out, but a few years ago a Republican city council voted to approve a measure despite the objections of the public. They are only found in mostly gerrymandered Republican districts. You can bet there will never be one in Berkeley or San Francisco! I highly recommend you watch Robert Greenwald's documentary "Walmart; The High Cost of Low Prices". The greed and underhandedness of this family and company is mind blowing. They have more employees dependent on food stamps and Medicaid than any other company in America but people are bi_ching about President Obama!

nerosmom: as crappy as it is, it's not illegal for them to schedule him that way (I linked the Texas Workforce Commission guidelines under my answer), so DOL probably won't do anything. :(
