I am forced to take my son for visitation with his grandma. He is in danger and i can't prove it. Can i hide a voice recorder when he visits?

He is 1 1/2 and cannot tell me what goes on in her house. There is a lot of heavy drinking and abuse. I just cannot get the evidence to prove in court. I am so scared for him having to go there. Live in ohio.

Agree with RBB,,no way you are going to hide a recorder. If you have reason to believe the child is in danger, have supervised visits. They can met with you and the baby. I don't know what legal rights they have, if any. Document everything. How do you know what's going on? I don't blame you for being concerned..No child should be around that atmosphere, and never left alone.

Ive tried for supervised visits, visitation house, anything were he isn't alone. The court just won't do anything unless i have proof of what goes on and it can't be hearsay. Its more emotional and mental than physical other than her letting him sleep alone with a pitbul when he was 6 months. When i found that out the visitation was over in my eyes. She admitted to that in court.

Ugh! She is grandparent? How does she have rights? Is she awarded joint custody ?

Bubblious, I want to talk about something (just for advice) but I can see this isn't the place to do it, as I would be cutting off you and Amom. If you will, could you find me somewhere on Ask.com? I'd appreciate it.

You need to talk to his grandma and try to negotiate a deal where either you come with him or she doesn't get to see him. Yes you should attach a tape recorder if you are a determined mother. Try and see if he will talk as a witness and tell the court what his grandma does. You have to do something about this...

At a 1 1/2 the court will not take anything.

It is court ordered visitation for Grandparents rights. He can't communicate well since he is only 1 1/2..Im just not sure if it is breaking a privacy law. Parents have no rights anymore if i don't take him there i go to jail. :(

Then you should stress to somebody that you are fearing for your son's life. Somebody has to do something to help you, or you're probably going to have to take a risk and do something about it yourself.

well how did you find out about the heavy drinking and abuse?

Don't leave him there alone. How can you hide a voice recorder on him when he's just 1 1/2?

Voice recorder won't work in court. They will just say that you altered there voices or digitally put words on the tape....................You need video evidence.

Sure you can hide a recorder, they are doing that like crazy right now to the inner city school teachers.

Is it because the grandparents were in custody?

They do not have any kind of custody. They were just granted grandparents visitation rights by the courts because i wouldn't let him go to their house alone anymore because of him being put in danger

It depends on your states law. Some states are one party consent states which means you can legally record any conversation in which you are a party. Your child would have to be the one doing the recording. If you aren't present you can't unless your state has a specific law addressing your situation.

Call your local Child Protection Agency and tell them what's happening. Let them take it from there. You have an obligation to protect that child.

I think MysticDesert is right. I don't know what to do though, besides pray for you and your son.

Can you buy one of those stuffed animals with the nanny camera inside and send it with the baby? Gosh, I am so upset over this. I hate the fact that the law doesn't take your concerns seriously! Whatever you do, take a picture of your baby, naked, before you bring them to the grandparents. Take a picture immediately when you pick up your baby. I know you say it's emotional, but still do that. I'd look into a nanny cam stuffed animal that records voices if nothing else and send that with the baby every time. All though it may be illegal to record without people's permission, but if you got something on tape, gosh, I would hope someone would listen to you. I have 3 babies, and a step child and I would end up in jail I guess... Which I know wouldn't help... But I feel for you... Truly... I'm so sorry....
