Is a miscarrage caused by an assault punishable by law

Son's girlfriend was head butted and shoved to the ground by her brother because he was upset she was pregnant during her 10 week of pregnancy, then he beat my son sent him to hospital, she did not want to go and this past week had some slight pain in lower abdominal area, today at her doctors appointment we found out that the baby has no heart beat, i feel like it is endangering the welfare of a child and if not then murder, although anything i know can happen during a women's first trimester. The boy is in jail with a 2nd degree assault and a domestic charge, just curious what others may think?

I would deffinantly pursue it. It is probably not considered murder (although it should be), but is considered manslaughter. Any idiot that would hit a pregnant female or any female deserves to go to jail. And then it causing a miscarriages, he should be sent to jail for a long time.

You need to get her medical records from the pregnancy & miscarriage & you guys need to go to the police station & file manslaughter charges or murder if they say that's possible. I am glad to hear that he is currently in jail. He needs to stay there a very long time.

I am so sorry for your loss. I know it's so hard to deal with. We have been trying to have a baby for a long time & I finally was able to get pregnant after 3 years of trying, but they have all (4) been miscarriages.

Sorry about your losses, I have two grown children who are now having children but my husband and i went through that a few years back (hormone issue) and i finally decided to get my tubes tied due to my age and im ok with it now cause god knows our future, we dont always see his reason right away but its amazing how it is disscovered to us and then we understand, i now have a granddaughter 5 mos and the loss pregnancy would have been grandchild number 2. Prayers are with you both and sad when good people want a child and can give them love and their needs and we see others who dont deserve children and have them like flys.

Yes, he can be faced with these kind of charges. I know murder is a bit severe but it is close to that. You should take the papers the doctor gave to you to the police's office. Sorry for your loss.

In some states it is not a crime at all, here in Colorado a lady was involved in a hit and run and lost an almost full term baby and the idiot can not be charged with murder or anything. Check your state laws

Thank you for your comment, my daughter is a new mother too so loving my grand daughter soo much has made this harder, it would have been my son's first and both (the cousins) would have been almost exactly the same age difference as their parents so it was gonna be pretty specail to us, but God has his plans and i do hope justice is served. Congrats on being new mom.

I'm so sorry for your loss. I believe you have been given some good advice. As for the baby, it depends on what state you live in. Some states will recognize assault on the mother to be but charge nothing for the death of the child. I hate that and it's so unfair.
