Can you go to jail if you don't tell someone you have herpes and you sleep with them anyways? My ex boyfriend has an ex that has it.

Sadly, no. Since herpes isn't a deadly virus they have no legal obligation to inform their partner. Messed up, huh? The only disease/illness where you must inform your partner is if you have the HIV virus.
What's really sad is people don't know that if you have had a cold sore, you have herpes. This is Herpes 1 that is in the mouth. It can spread to Herpes 2 in your genitals. And can be spread through skin on skin contact. (If you have a cold sore than touch your private parts you can get herpes 2 of the genitals.)

Simplex 1, when spread to the genitals is still considered by doctors to be Simplex 1 despite the outbreak occuring in the genitals. The Simplex does not change based on location. The same is true for Simplex 2. Also, the chance of spreading the virus by touching your mouth and then your genitals is slim to none. Similar to how people have the misconception herpes can be spread on toilet seats.
In some instances, legal action may be taken. States such as Florida may deem the action to be a misdemeanor. In states where this action cannot be taken, however, an individual may file a civil lawsuit.

384.24?Unlawful acts.—
(1)?It is unlawful for any person who has chancroid, gonorrhea, granuloma inguinale, lymphogranuloma venereum, genital herpes simplex, chlamydia, nongonococcal urethritis (NGU), pelvic inflammatory disease (PID)/acute salpingitis, or syphilis, when such person knows he or she is infected with one or more of these diseases and when such person has been informed that he or she may communicate this disease to another person through sexual intercourse, to have sexual intercourse with any other person, unless such other person has been informed of the presence of the sexually transmissible disease and has consented to the sexual intercourse.

(2)?It is unlawful for any person who has human immunodeficiency virus infection, when such person knows he or she is infected with this disease and when such person has been informed that he or she may communicate this disease to another person through sexual intercourse, to have sexual intercourse with any other person, unless such other person has been informed of the presence of the sexually transmissible disease and has consented to the sexual intercourse.

Yes because his ex girlfriend has herpes. He continues to cheat on me with her. I ended up getting pregnant by him. He continued to see her behind my back. It is now the end of February and I recently found out he had sex with her in June. I was pregnant then. My son is now 6 months old. But it still crosses my mind what if he contracted it and has been keeping it from me.
