Can my landlord refuse my rent if i cant pay the late charge the same day?

my rent is due on he third. i got paid the 4th. iput the rent in the night drop box after work on the fourth. i came home and i had a 3 day notice with an added page for the late fee of $50.00. and my money order was returned because the late fee is not included. they are refusing to take my rent money because i cant pay the fifty dollars late fee til next pay day what do i do? can they do this?

In my state there is a tenant landlord act. The landlord should take the rent because... Under the tenant landlord act, they have to give a three day notice to quit. You can pay the rent and late fee and stay or they can continue to try to evict you. The landlord would have to serve a seven day notice to appear in court. At court it is possible to avoid eviction, if you tried to pay the rent and the landlord refused to take payment. See if there is such an act in your state law.

You know how "they" say "ignorance of the law is no excuse!"... Each state has a Code book where the law is written down. You can probably access it at the public library. Each code has a "Popular Name" index. Look for Real Property or Tennant and Landlord Act.

In most states they can refuse the rent if you are late often. They cannot put you out unless you already received a court order to leave within 30 days. So you have a lot of time and money to find somewhere else to live. So you don't have to go through this headache again, you should seek another place to live. They can't put you out until you go to court. You shouldn't want to stay in a place where you are not wanted. They will continue to give you this problem every time you are late.

thankyou so much . ive never been late on my rent just had a slow week.I did pay the rent in full so i dont know why theyre doing this. and i wasnt aware of any tenant landlord information that was accurate.... thank you all so much

Read your lease! They probably can!

They can reject a partial rent payment, but not a full one. And the late fees do not have to be included with the rent. And, just in case they try to screw you on the late fees, those stop accruing once the rent is paid. Give them the late fees, and tell them to shove their 3 day notice. They can't do anything and they know it, now you know it too.

I have worked in apartment rentals for a long time. Granted, my experience has all been in TX, but you can google the website for the apartment association of your state. Basically, as long as your bills are paid, you are protected. The letter they gave you is more than likely the standard letter that the apartment gives to everyone who pays late. That letter will only be followed up on in the case of nonpayment.

Yes, your late fee should actually be deducted from the rent money, which would make u in default of rent. If landlord takes any money from you they will have to start the eviction process over through the court.
