Can I file 2011 taxes and get my refund if I still have not done 2010 taxes where I will owe?

2010 was very complicated. we had a failed business that lost money but my wife is very sick and she is the only one that can put together all of the documentation to show our loss. I lost my job that year and took money from a 401k which is why I owe for 2010. 2011 by itself I am sure I would get a refund. I don't know if I can just file 2011 and get a refund and leave 2010 alone until my wife is well enough to deal with the complications of 2010 or will they not give me my refund because 2010 is outstanding still. help?

This will depend with the amount of income you were gaining during the year 2010. It is possible for you to file for these taxes though there might be some deductions of a certain percentage for 2010. Consult the respective offices for advice.

The longer you wait to file, the more interest will accrue on what you owe. See an accountant. Basically if you file 2011 and have a refund, they will keep it until you file 2010 because they think you owe them.
