Can grandparents file for rights if spouse has criminal record

daughters going through divorce and her husband wont let her father see grandkids from criminal past, can i file for grandparents rights for us both

I know in Maryland where I live grandparents do have legal rights to visitation with their grandchildren. You will have to retain a lawyer and possibly go to court unless it can be settled through arbitration. Either way you will have to retain a lawyer. As for the father, that will depend on what criminal acts he has been convicted of. If it was against the mother or the child then there may be stipulations on any visitation you may get. Such as supervised visitation or something to make sure he is not in any contact with the children. I hope this helps. Somebody I work with recently went through a similar situation. Their son was addicted to drugs and was not allowed in or around their home, and the mother of the children had a protective order on him. They received visitation ( I'm not sure how often) but it was made very clear that if the children had any contact with the father there visitation rights could be relinquished.

Your best bet would be to talk to a lawyer, and a lot will depend on exactly what sort of crime he was charged with, as to if it will prevent you from being able to exercise your grandparents rights.
